1.1. The following packages are available under the Service, which enables the subscriber (as landlord) to report a tenant’s rental default to Credit Bureau Malaysia Sdn Bhd (“Credit Bureau“) as a trade credit reference. The Service is provided on a per-submission basis, covering one (1) tenant’s rental default information only.
(a) Standard Package (RM90.00 before SST / RM97.20 after SST), which includes notification to the tenant via:
(i) one (1) SMS;
(ii) one (1) email; and
(iii) one (1) successful phone call (with up to three (3) call attempts).
(b) Premium Package (RM150.00 before SST / RM162.00 after SST), which includes notification to the tenant via:
(i) one (1) SMS;
(ii) one (1) email; and
(iii) one (1) successful phone call (with up to three (3) call attempts); and
(iv) one (1) formal notification letter issued on the letterhead of the Credit Bureau appointed law firm (“Letter“).
Each package fee constitutes full consideration for the Service in respect of that submission, and no further fees shall be payable for any subsequent updates, modifications, or maintenance of the same rental default record.
1.2. For the avoidance of doubt, the notification services under each package apply to a single rental default submission per tenant. Any subsequent updates or amendments to the same rental default record, including changes to the outstanding amount or payment status, shall not trigger any new, additional, or refreshed notifications.
1.3. Notwithstanding anything to the contrary, the Letter is not a substitute of the letter of demand officially issued by a creditor to initiate legal proceedings nor is it a letter of demand, notice of default, or any statutory or pre-action notice under applicable law, and shall not be relied upon, produced, or used by the subscriber as a basis to commence, support, or maintain any claim, proceeding, or enforcement action in court, arbitration, or otherwise. The sole purpose of the Letter is to serve as a formal communication of the relevant trade credit reference (i.e. rental default) to the identified tenant, and not to create or evidence any cause of action.
1.4. All notifications included with any packages are made on a reasonable effort basis, and Credit Bureau do not guarantee successful delivery in all cases (e.g., where tenant contact details are invalid, inactive, or blocked).
2. Subscriber’s Responsibilities
2.1. Subscriber is solely responsible for ensuring that:
(a) All information submitted to Credit Bureau is accurate, complete and current at all times, and not false, misleading, or malicious in any respect;
(b) All information submitted is lawfully obtained and provided in compliance with applicable data protection and privacy laws, including procuring all necessary consents from the tenant or any relevant individual prior to submission;
(c) The submission of tenant information, including any rental default details, does not infringe any third party’s rights or breach any contractual, statutory, or fiduciary obligations owed by the subscriber;
(d) The use of the Service is solely for legitimate trade reference submission purposes and not for any unlawful, defamatory or discriminatory purposes;
(e) The subscriber maintains proper records evidencing the basis of the submission (including the tenancy agreement and proof of default) and shall provide such records to the Credit Bureau upon reasonable request for verification or audit purposes; and
(f) Any updates, corrections, or withdrawals of previously submitted information are promptly notified to the Credit Bureau in writing to ensure the accuracy and integrity of the Credit Bureau’s database.
2.2. The subscriber shall indemnify and hold harmless the Credit Bureau from and against any claims, losses, liabilities, or expenses arising out of or in connection with any breach of the terms governing the Service or any misuse of the Service by the subscriber.
3. Fees & Payment
3.1. Fees are payable per submission, according to the package selected. All fees must be paid in full at the time of submission.
3.2. Fees are non-refundable once the submission has been submitted or processed, regardless of any subsequent updates, withdrawal, or cancellation of the submission.
4. Disclaimer and Governing Terms
4.1. The Service is provided on an as-is basis. Credit Bureau do not guarantee rent recovery, tenant response, or any specific outcome arising from the submission or use of the Service. To the fullest extent permitted by law, the Credit Bureau disclaims all warranties, representations, or conditions in relation to the Service, whether express or implied, including but not limited to warranties of fitness for a particular purpose or non-infringement. To the extent permitted by law, the Credit Bureau shall not be liable for any loss, damage, cost, or expense (whether direct, indirect, incidental, consequential, or otherwise) arising from or in connection with the use of, or reliance on, the Service or any information submitted, displayed, obtained, or otherwise made available through or in connection with the Service.
4.2. The inclusion, submission, display, or availability of any information through or in connection with the Service does not constitute any representation or endorsement by the Credit Bureau of such information. All such information remains the sole responsibility of the subscriber or the data source from which it originated.
4.3. The Service, including access, use, and submission activities, shall be governed by and subject to the Credit Bureau’s Subscription Agreement and related terms and conditions applicable to its products and services, as may be amended from time to time and made available on the Credit Bureau’s platform. By using or submitting through the Service, the Subscriber acknowledges and agrees to be bound by the terms herein and the said Subscription Agreement (including any updates thereto).
5. General
5.1. The Credit Bureau reserves the right to vary, modify or update the terms herein at any time at its sole discretion.
